Contractual Terms and Conditions
These general contractual terms and conditions expressly regulate the relationships arising between LANTIER SL, with Tax ID B75125336, with business address for tax purposes at Pol. Ind. Aldaba s/n. 20400 TOLOSA (hereinafter LANTIER) and You (hereinafter the USER).
LANTIER complies with the provisions of Law 34/2002 of Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contractual Terms and Conditions, Royal Decree 1906/1999 which regulates telephone or electronic contracting with general conditions under development of article 5.3 of Law 7/1998, Law 26/1984 for the Protection of Consumers and Users, Law 7/1996 for the Regulation of Retail Trade and however many laws are applicable.
The use on the part of the USER of the portal and the acquisition of any of its products means the full and totally unreserved acceptance of each of the clauses of the General Contractual Terms and Conditions and of the Legal Warning.
Applicable Law and Jurisdiction
This contract shall be governed by Spanish law.
The parties expressly renounce their own jurisdiction and submit themselves to the Courts and Tribunals of San Sebastian (Gipuzkoa) , to solve any dispute that may arise regarding the interpretation or execution of the present contractual terms and conditions.
LANTIER pays close attention to the information related to the essential characteristics of the products by means of descriptions and photographs which illustrate the products (bearing in mind that they are for guidance only). All this is done within the limits of technology and respecting the market’s highest standards.
LANTIER reserves the right to modify the prices shown incorrectly on the LANTIER online shop.
It should be borne in mind that orders shall be sent within the limits of available stock.
Should there be any stockouts or temporary unavailability of any article, we are committed to sending an email to communicate the date when we will be able to send your product(s).
If any of the articles in your order are not available, we are committed to sending the available articles and we will put forward a proposal to send an equivalent article as a substitute for the unavailable article; should this prove impossible, we will cancel the order and provide a partial refund.
For placing orders, once the USER (registered) finds the desired product, they must simply click the “Add to Basket” button which appears alongside the product. The USER is able to access their Basket at any moment (and review its content, modify it, etc.).
When the USER has selected the desired products, conveniently kept and stored in the Shopping Basket, they will be able to finalise the purchase by clicking “Place Order”. This action will take the USER to the “Purchase Form”. LANTIER will request the filling in of the purchase form with the USER’s personal data, as well as the data corresponding to the delivery and invoicing of the order carried out.
The inclusion of the data in the purchase form implies the reading and irrevocable acceptance of each and every one of the present General Terms and Conditions. The purchase is understood to take place at the business address of LANTIER.
Once the purchase has been carried out and in the briefest possible period from the carrying out of the purchase, LANTIER will send the USER proof of purchase by email.
The purchase prices will be those in force at the moment at which the purchase is made.
Once the invoice has been made there can be no modifications to it, in compliance with the current regulations. (Royal Decree 1496/2003 on rules of Invoicing, modified by Royal Decree 87/2005). The invoice shall be issued in the name of the natural person or company that makes the order, therefore, the customer must make sure the order is made in the correct name. Subsequent changes will not be possible.
If you wish to cancel the contract, you must send an unequivocal statement to LANTIER (firstname.lastname@example.org) stating that you wish to cancel this contract. In your statement you must include your name, address, telephone number, email address, order number and the products you wish to return.
The prices of the products shown on the website DO NOT include the current taxes, the final sale price applied to the customer being that which corresponds after the application of the corresponding taxes and according to the conditions offered in each case, depending on the destination of the order. The transportation costs shall be payable by the buyer.
Payment of the amounts referred to shall be carried out according to the terms agreed upon in each case under the particular applicable conditions or, alternatively, by means of credit card.
LANTIER reserves the right to decide at all times the products and service it offers the USERS via its portal. Thus, LANTIER will be able to include new products at any moment. LANTIER also reserves the right to terminate, at any moment and without prior notice, access or to modify information and prices of any product on sale on the portal.
Should there be a typographical error in any price or product displayed and should any USER have made a decision to carry out a purchase based on said error, LANTIER shall communicate to the USER said error and the customer shall be entitled to cancel their purchase free of charge.
The price of the products shall be that stipulated at each moment on our website.
Obviously, the price and other conditions of the items you have requested shall not be modified during the period of time between the offer and acceptance of the same issued by means of the shipping confirmation, unless to legal reasons or the decision of government agencies should oblige us to make retroactive changes to said policies, Conditions or the Privacy Statement, in which case the possible changes will also apply to orders previously placed.
The prices shown on the website are shown in euros, do not include possible discounts, nor the applicable VAT on the date of the order, nor the shipping costs, which are included separately on the website.
In the case that shipping costs are incurred they will be the responsibility of the Customer and will be shown on the invoice separately from the sale price of the products. You will be informed, before the definitive registration of your order, of the shipping costs related to said order, and the payment will be requested for the total amount of the purchase.
The payment can be made according to the agreed terms in each case under the particular applicable conditions, or, alternatively, by means of a VISA, VISA Electron, Maestro MasterCard and 4B bank card.
As a security measure your data will be encrypted before the transfer of information from your computer to the secure payment system, using RedSys (Sabadell) with your credit or debit card.
LANTIER does not receive or store the data from your debit or credit card. You will know the page is secure because of the padlock in the lower part of the browser (or if the website address begins with https). This method is the recognised standard to carry out secure transactions.
Upon clicking “Authorise Payment” you are confirming that the bank card is yours.
Bank cards are subject to validation checks and authorisation by the issuer of the same, but if the issuer fails to authorise payment, we will not be responsible for any delay or non-delivery and we cannot formalise a Contract with you.
Upon confirmation of your order, LANTIER will send a confirmation message stating that your order has been properly registered. The transfer of risk of loss and deterioration of the products will take place after the delivery and receipt of the Products by the Customer.
If for reasons beyond our control we are unable to meet the delivery deadline, we will inform you of this fact and offer you the option to proceed with the purchase establishing a new delivery date or to cancel the order with a full refund of the price paid within a maximum period of 30 days from the date the order cancellation occurs via the same payment method with which the online order was paid unless you choose a different payment method.
We do not make shipments on Saturdays, Sundays, or bank holidays.
For the purposes of these Terms and Conditions, it shall be deemed that the “delivery” has taken place or that the order has been delivered at the time of signing the receipt at the agreed delivery address.
Returns / Cancellation:
IF YOU HAVE PURCHASED AN ARTICLE YOU DID NOT WISH TO BUY:
If you are not satisfied, we will refund your money. The items on offer on the LANTIER website have a refund period of 15 working days from the date of delivery of the order (it is understood that the order has been delivered at the time of signing the receipt at the agreed address). Within this period the product can be returned. (Please contact us to inform us if this is the case).
The product must be returned, in its original packaging and in perfect condition, to our warehouse:LANTIER S.L.

The return shipping costs will be the responsibility of the customer. We are not responsible for broken or lost packages. When our Quality Department confirms that the returned product is in perfect condition, the refund will be processed or the product exchanged according to the agreement in each specific case.
IF THE PURCHASED ARTICLES HAVE BEEN BROKEN DURING SHIPPING:
If you receive the shipment with damaged goods, please indicate it in writing on the delivery note or transport document and contact us (email@example.com) within 24 hours of delivery, in order to arrange the return with the transportation company.

In this case LANTIER shall assume responsibility for the shipping costs and we shall arrange the dispatch of a replacement.
In the event of exchanging an article found to be defective, we will be responsible for the postage and will respond to any non-conformities within a period of 6 months from the date of delivery. The consumer and the user must inform LANTIER of the non-conformity within a maximum period of 15 days from being first aware of it.
To process the refund, it must be indicated in writing on Lantier’s delivery note and said document should be scanned and sent to us via email to firstname.lastname@example.org as soon as possible.
In the event of receiving a defective product, LANTIER offers a guarantee on commercialised products, under the established legal terms.
Furthermore, according to Article 116 of TRLGDCU (Consolidated Text of the General Consumer and User Protection Act and other related provisions) on the conformity of products with the contract it is understood that: Unless proved otherwise, it shall be understood that the products are in conformity with the contract whenever they fulfil all the requirements expressed below:
- They meet the description given by the seller and possess the qualities of the product which the seller has presented to the consumer and user in the form of a sample or model.
- They are fit for the purposes for which products of the same type are normally used.
- They present the usual quality and performance of a product of the same type which the consumer and user may reasonably expect, given the nature of the product.
In cases of proven non-conformity of the product with the contract, LANTIER shall proceed –in such a case and where relevant– with the repair, replacement, price reduction or termination of the contract negotiations that shall be free of charge for the consumer and user.
LANTIER takes responsibility for and guarantees that personal data will be treated in accordance with the provisions developed within the framework of Spanish laws and their future modifications.
The personal data that you provide to us will be processed in a file which is the responsibility of LANTIER and whose aims are:
- The development, compliance with and execution of the contract of sale of the products which have been acquired or any other contract between both parties;
- To provide you with information about LANTIER products, including, in relation to such products, sending commercial communications via e-mail or via any other means of electronic communication (such as SMS) as well as by making telephone calls.
- LANTIER with business address at POL. IND. ALABA S/N, being responsible for the file, undertakes to respect the confidentiality of your personal information and guarantees the exercise of your rights of access, rectification, cancellation and opposition by writing to the above address to the attention of “Función LOPD” or by sending an email to email@example.com in both cases providing a copy of your national identity document or passport or another valid identification document. Should you decide to exercise these rights and as part of the personal information you have provided to us there is an e-mail address, we would appreciate it if in the aforementioned communication you could specifically state that circumstance providing the email address with respect to which the rights of access, rectification, cancellation and opposition are being exercised.
- The USER (you) hereby guarantees that the personal data provided are true and accurate and undertakes to notify any change or modification thereof. Any loss or damage caused to the site or to the person responsible for the website or any third party by erroneous, inaccurate or incomplete information in the registration forms will be the sole responsibility of the user.
